Question about apartment eviction in Atlanta GA?
asked:
If apartment eviction is filed on the 10th of the month at 9:00 AM promptly by the apartment landlord and apartment company, how many days will you have before they actually set your furniture out and you have to move?

(I had an employment issue and won’t be able to return to work until the 29th of Sept ‘09, thus I have already missed Sept ‘09 rent, and I’ve recieved my first notice, only stating the rent owed, plust the $300 in eviction fees owed, but the notice has no time frame on them. Please help!!!)

If you failed to pay your rent and the landlord filed paperwork for eviction at the courthouse here are the steps that need to be done before the sheriff shows up to put your stuff on the curb.
1) landord files paperwork in courthouse for eviction.
2) sheriff will come to your address to give you notice of the eviction filing. You have 7 business days from the date the sheriff gives you notice to file an answer at the courthouse. If the 7th day files on a weekend you will have the following monday to answer.
3) you can either file an answer at the courthouse or fail to file an answer and the process differs based on your action
If you answer
4) the court will set a court date at the next available court hearing which is usually the week after your file your answer since this gives the court time to send notice to both you and landlord of the date and time of the court hearing.
5) you have court hearing date. If you fail to show up the landlord will immediately be given a write of possession. If you show up and have not paid your monies owed then the court will give landlord a writ of possession exactly one week later.
6) once landlord has writ he gets request from sheriff (or marshall) office to set date and time to do the eviction and put your stuff on the curb.
if you do not answer the notice of eviction
4) landlord has to request a writ of possession from the court which will take 2 days since judge has to sign it
5) once landlord has writ he gets request from sheriff (or marshall) office to set date and time to do the eviction and put your stuff on the curb.
I own 32 rental properties in gwinnett and dekalb county and this is the process for all counties in the state of georgia as detailed in section 44 of georgia law code.
