How can I kick out a tenant without paying a relocation fee?

The price tag on relocation is very steep. The tenant we have excessively uses electricity and hot water in an aggressive attempt to raise utility fees.

This is evident because of the high amount of music he blasts in the middle of the night at maximum volume, as well as running hot water for the entire night.

Well, if he has broken part of the lease, you could always evict him. If you don’t have a written lease, you’re technically on a month-to-month, and you can kick him out as long as you give him a 30-day notice. I don’t see why you would have to pay relocation fees for either of those situations.

You can evict for all those reasons or you don’t need a reason at all. All you need to do is give a 30 day written notice. You are not responsible for his relocation fees

Your option is the loud music, not utility usage.

Loud music in the middle of the night is a disruption of neighbors right to a peaceful and enjoyable living enviorment. It’s against housing laws. Serve him anotice for the music first. If it doesn’t work serve him a second by certified mail and han eliver it, or post it on door. If he is doing these things on purpose to aggrivate you he’ll probably continue doing so. After the 2nd notice serve a 30 day notice to evict. You will not have to pay relocation fees and if he threatens to take you to court, you will have proof that you served him with reasonable notice to fix a problem and he didn’t. As Fas as the utilities you can’t really do anything about that. Us the music as a reason to get him out. Its your only way at this point. Unless you don’t have a written agreement then just give him a 30 day notice and say bye bye!
